1. OBJECT

The purpose of these conditions is to regulate the purchase-sale operations entered into with Shaula Confort through this Website. The contracting conditions set forth herein are duly registered in the general contracting conditions registry of the Mercantile Registry of Murcia.

2. PRODUCTS

The description of the products offered on the Website is based on the production information from Shaula Confort. Photographs and/or videos are shown for informational purposes only. Shaula Confort reserves the right to update the products offered on the Website daily, considering market and production circumstances.

3. CLIENTS

Any user will acquire the status of client from the moment they confirm their order. The data provided by the client will only be used to correctly deliver the product. For more information regarding data processing, we suggest you visit our privacy policy.

4. EXECUTION OF DISTANCE CONTRACT

Unless otherwise agreed by the parties, the business must execute the order without undue delay and at the latest within 30 calendar days from the date of the contract.

5. FAILURE TO EXECUTE DISTANCE CONTRACT

If the business fails to execute the contract because the good or service is unavailable, the consumer must be informed and must recover any sums paid without undue delay. In case of unjustified delay in the refund, the consumer may claim double the amount owed, without prejudice to their right to compensation for damages exceeding that amount.

6. PLACING THE ORDER

To place an order, the user must fill out the purchase form with their personal and payment details. Purchasing any product requires activating the order confirmation button at the bottom of the purchase request page. This confirmation implies full acceptance of these conditions. Once the order is received, Shaula Confort will immediately send the Client an email confirming the transaction details. This confirmation will be sent to the email address provided by the Client in the purchase form.

7. PRICES

All prices are indicated in euros and include applicable taxes. The price of each product will be that in effect on the order date. Shaula Confort will specify the components and amounts before the user validates their purchase. Any offer will be clearly marked, distinguishing the original and discounted prices. SHAULA CONFORT S.L. reserves the right to modify prices at any time without prior notice, always before the order is finalized.

8. PAYMENT METHODS

The Client may pay by any of the following secure methods:

  • Visa

  • Visa Electron

  • MasterCard

  • Paypal

  • Bank Transfer

Shaula Confort will send the Client an electronic invoice unless the Client requests a paper version to the address provided.

9. DELIVERY

Delivery time starts from when the order is received during working hours. Once shipped, Shaula Confort will email the tracking number for order tracking.

Deliveries are made Monday to Friday, excluding Saturdays, Sundays, and national or local holidays when deliveries do not occur. Delivery times are estimates and may be affected by factors beyond Shaula Confort’s control; if so, the Client will be informed. Delays requested by the Client or due to inability to contact the Client at the provided address are not considered a breach.

Orders paid by Bank Transfer are processed once the operation is validated by the bank, typically requiring 2 extra days.

Orders to islands may incur additional shipping fees, indicated at purchase time. Delivery times may increase by 1 to 3 days.

Delivery times may be affected by high order volumes or stock shortages. The transport company may vary to improve service or due to inability to collect.

10. SHIPPING COSTS

Free shipping throughout Europe, except islands which may have a small shipping fee.

11. CANCELLATIONS AND RETURNS

Clients have 14 calendar days from receipt to exercise their right of withdrawal without justification. Returns are free if the mattress is in original packaging and unused, and the product is in perfect condition.

If products are returned outside original packaging, used, or damaged, the Client must cover the €100 collection shipping cost, payable once pickup is arranged.

If products cannot be returned due to loss, destruction, or other reasons, the Client may still exercise withdrawal rights but must compensate for market value if the inability to return is attributable to them. Shaula Confort reserves the right to reject withdrawal if the product packaging is opened or tampered with.

If the Client receives incorrect or damaged goods, they may choose contract cancellation or product replacement. Shaula Confort will collect the merchandise at the delivery address. The Client must send a complaint with photos/videos to shop@shaulaconfort.com. No costs will be charged in this case.

12. BUSINESS OBLIGATIONS AND RIGHTS IN CASE OF WITHDRAWAL

  1. Shaula Confort will refund any payment within 30 calendar days after being informed of the withdrawal.

  2. Refunds will be made using the original payment method unless otherwise agreed, with no cost to the Client.

  3. Shaula Confort may withhold the refund until goods are received or proof of return is provided.

  4. If a product has a manufacturing defect, Shaula Confort will refund or replace it.

13. CLIENT OBLIGATIONS

The Client guarantees the information provided is truthful and accurate. The Client agrees to provide a delivery address accessible during usual delivery hours. Shaula Confort is not responsible for delays due to incorrect addresses. The Client must use products legally without harming third-party rights. Breach of these obligations allows Shaula Confort to cancel orders or withdraw products without notice and without compensation.

14. WARRANTIES AND OBLIGATIONS OF SHAULA CONFORT S.L.

Shaula Confort is legally responsible for product warranties. Product content and labeling responsibility lies with the packager, in compliance with applicable law. Product availability depends on telecommunications and internet systems, which Shaula Confort cannot guarantee uninterrupted. Shaula Confort is not responsible for interruptions or errors beyond its control (e.g., software, hardware, network failures). Shaula Confort cannot guarantee permanent availability or exact delivery times but will make efforts to comply. Clients retain the right of withdrawal as per section 8.

15. PARTIAL INVALIDITY

If any condition is legally invalid, it will not affect the validity of the remaining provisions.

Our Privacy Policy applies to personal data collected and processed by Shaula Confort according to the EU Regulation 2016/679.
