OBJECT

The purpose of these terms and conditions is to regulate the purchase and sale transactions entered into with SHAULA CONFORT S.L. through this Website. The contracting conditions presented herein are duly registered in the register of general contracting conditions of the Mercantile Registry of Murcia.

PRODUCTS

The description of the products offered on the Website is made according to the information provided by the suppliers of SHAULA CONFORT S.L. – SHAULA CONFORT S.L. reserves the right to update daily the products offered on the Website depending on market conditions.

CUSTOMERS

Every user will acquire the status of customer (hereinafter, “the Customer”) from the moment they confirm their order.

EXECUTION OF DISTANCE CONTRACT

Unless otherwise agreed by the parties, the business shall execute the order without undue delay and no later than 30 calendar days from the conclusion of the contract.

FAILURE TO EXECUTE DISTANCE CONTRACT

If the contracted goods or services are not available, the consumer must be informed and offered the following alternatives:

  • Wait for a new delivery deadline

  • Opt for a product of similar or superior characteristics

  • Request cancellation and refund

ORDER FORMULATION

To place an order, the user must fill out the purchase form indicating their personal and payment details. The purchase of any product requires activation of the order confirmation button appearing at the bottom of the purchase request page. This confirmation implies full acceptance of these conditions. Once the purchase order is received, SHAULA CONFORT S.L will immediately send the Customer an email confirming the details of the transaction. This confirmation will be sent to the address provided by the Customer in the purchase form.

PRICES

All prices are indicated in euros and include applicable taxes. The price of each product will be the one in force on the date the order is placed. Before the user validates their purchase, SHAULA CONFORT S.L. will specify which items are included and their respective amounts. If an offer applies, it will be clearly marked and distinguished between the original price and the discounted price. SHAULA CONFORT S.L. reserves the right to modify prices at any time without prior notice, always before the order is finalized.

PAYMENT

The Customer may pay their order using any of the following methods: Visa – Bizum – PayPal.

If the customer wishes, SHAULA CONFORT S.L. will provide an invoice in paper and/or electronic format by sending an email to shop@shaulaconfort.com.

DELIVERY

Mattresses have a general preparation and delivery period of 2 to 6 working days. Delivery times exclude Saturdays, Sundays, and national and local holidays for orders placed before 13:00. For orders placed after 13:00, delivery times will be extended by 24 hours. Delivery times may be affected by circumstances beyond shaulaconfort's control (weather conditions, force majeure, etc.).

Orders paid by bank transfer will be processed once the transaction is validated by the bank, generally requiring 2 additional days to complete and process shipment.

Orders to the Balearic Islands and Portugal will incur a 6% management fee, which will be communicated before order confirmation, as well as an additional delivery time of 1 to 3 days.

For shipments to Ceuta, Melilla, Canary Islands, and Andorra, please contact directly at shop@shaulaconfort.com.

The transport agency may vary exceptionally due to inability to pick up or to provide better customer service.

This page offers FREE SHIPPING included in the final price.

CUSTOMER OBLIGATIONS

The Customer guarantees that the information provided when filling out the contracting forms is truthful and accurate. The Customer commits to facilitate delivery by providing an address where the order can be delivered within the usual delivery hours.

SHAULA CONFORT S.L. will not be responsible for delivery delays if the address provided by the Customer is incorrect. The Customer agrees to make lawful use of the products purchased without infringing on the rights or interests of any third party. Failure to comply will empower SHAULA CONFORT S.L. to cancel the purchase order or withdraw the product without prior notice. The Customer will have no right to claim compensation.

RIGHT OF WITHDRAWAL

You have the right to withdraw from this contract within 14 calendar days without giving any reason. The withdrawal period expires 14 calendar days after the day on which you or a third party other than the carrier acquire physical possession of the goods. To exercise your right of withdrawal, you must notify SHAULA CONFORT S.L. at C/ las tejeras, 12 – Yecla (Murcia) or by email to shop@shaulaconfort.com of your decision to withdraw by an unequivocal statement (e.g., a letter sent by post or email). To meet the withdrawal deadline, it is enough that the communication is sent before the period expires.

In case of withdrawal, we will reimburse you the full amount paid within 14 days after accepting the return, using the same payment method unless otherwise agreed. We may withhold the refund until we have received the goods or you have provided proof of return.

You must return the goods to SHAULA CONFORT S.L., C/ las tejeras, 12 – Yecla (Murcia), without undue delay and no later than 14 days from the withdrawal notification.

You bear the direct costs of returning the goods. You are only liable for any diminished value resulting from handling the goods beyond what is necessary to establish their nature, characteristics, and functioning.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

According to Article 103 of Law 3/2014 of March 27 (which modifies the General Law for Consumer Protection):

The right of withdrawal does not apply to contracts concerning:

  • Services fully executed with prior express consent of the consumer, acknowledging loss of withdrawal rights.

  • Goods or services whose price depends on financial market fluctuations beyond the business's control.

  • Goods made to consumer specifications or clearly personalized.

  • Goods liable to deteriorate or expire quickly.

  • Sealed goods not suitable for return due to health or hygiene reasons, once unsealed.

  • Goods inseparably mixed with other items after delivery.

  • Alcoholic beverages agreed upon at contract time that cannot be delivered within 30 days, whose value depends on market fluctuations.

  • Contracts for urgent repairs or maintenance requested by the consumer, except for additional services or goods.

  • Sealed audio/video recordings or software unsealed after delivery.

  • Daily press, periodicals, or magazines (except subscription contracts).

  • Contracts made by public auction.

  • Accommodation services, transport, vehicle rental, catering, or leisure activities with specific execution dates.

  • Digital content not supplied on a tangible medium once execution has started with prior consumer consent.

The right of withdrawal is not applicable for sealed goods unfit for return due to health or hygiene reasons once unsealed after delivery.

WARRANTIES

  • In case of defective products, the seller shall proceed with repair, replacement, price reduction, or contract termination, free of charge for the consumer.

  • The seller is liable for non-conformities manifested within three years of delivery.

PARTIAL NULLITY

If any condition is deemed unlawful or invalid, it will not affect the validity of the remaining provisions under current law.
